Program Development, Classification and Licensing

The foundation of any trade compliance program is identifying the appropriate jurisdiction (EAR or ITAR), your product and technology classifications (CCL or USML), and then the export licensing requirements. 


Once IBConformité LLC determines the applicable requirements, it is time to build a client-specific customized program, including an Export Compliance Program Manual (ECP) or Internal Controls Program Manual (ICP).


  • Are support and NPI gates for new product classifications needed? 
  • How are export compliance screenings conducted, including restricted party and embargo or sanction screening?
  • How are export licensable shipments identified, and how are export licensing submissions handled?

Once the foundation for a program is in place, training employees is needed to understand how each of their roles relates to trade compliance. 


Annual all-employee training is recommended, along with periodic functional training. 


  • When was the last all-employee awareness training?
  • Has targeted trade compliance training been conducted for specific workgroups?


Audit


The next important step is conducting an audit. An audit ensures that what is in place is working as designed, identifies gaps, and addresses opportunities for improvement.


  • Are periodic audits being conducted on workgroups with trade-compliance-related roles?
  • Are annual audits being conducted?
